Following a jury trial in Burleigh County, North Dakota, Brownson Norby, PLLC partner Kristi K. Brownson has obtained a defense verdict on behalf of her client Minndakota Limited Partnership, doing business as Radisson Hotel, Bismarck. The trial involved a personal injury claim against the Radisson Hotel in Bismarck by a hotel guest who claimed he was seriously injured at the hotel. This claim was the first time such a claim had been made against the hotel. The nine person jury returned a verdict finding no liability against the Radisson Hotel. Because the jury found in favor of the hotel on the liability question submitted to it, it was not required to reach questions of the five separate items of damages claimed.
The Court has entered judgment against the Plaintiff, and in favor of the Defendant Radisson Hotel, dismissing the case in its entirety, but awarding the Defendant Radisson Hotel judgment against the Plaintiff for its costs and disbursements incurred in defending the case.
The case is Jeffrey Wotzka v. Minndakota Limited Partnership d/b/a, Radisson Hotel, Bismarck, Burleigh County, North Dakota, District Court, South Central Judicial District, Case No. 08-2011-CV-1867.
